CPSC Grants One Year Stay of Testing and Certification Requirements for Certain Products
The U.S. Consumer Product Safety Commission voted unanimously 2-0 to issue a one year stay of enforcement for certain testing and certification requirements for manufacturers and importers of regulated products, including products intended for children 12 years old and younger. These requirements are part of the Consumer Product Safety Improvement Act CPSIA, which added certification and testing requirements for all products subject to CPSC standards or bans.
Significant to makers of children’s products, the vote by the Commission provides limited relief from the testing and certification requirements which go into effect on February 10, 2009 for new total lead content limits 600 ppm, phthalates limits for certain products 1000 ppm, and mandatory toy standards, among other things. Manufacturers and importers – large and small – of children’s products will not need to test or certify to these new requirements, but will need to meet the lead and phthalates limits, mandatory toy standards and other requirements.
Publix Issues Voluntary Recall on Produce Snacks (January 30)
Publix Super Markets is issuing a voluntary recall for six (6) varieties of produce snacks. The products contain peanut products that are from Peanut Corporation of America, which has been implicated in a national outbreak of Salmonella.

Pierre’s Ice Cream Company Issues Voluntary Recall on its Pierre’s Brand Sundae-Cone Style Products Due to Expanded Peanut Recall by Peanut Corporation of America (PCA) (January 30)
Pierre’s Ice Cream Company has not received any consumer illness complaints associated with our products. However, we are taking the precautionary steps including removing all the impacted products from retail store shelves and the entire distribution system.

Kemps LLC is voluntarily recalling the products listed below. The company initiated the voluntary recall in response to an expanded recall by Peanut Corporation of America (PCA). PCA’s expanded recall now includes all peanuts and peanut related products manufactured at their Blakely, GA facility. The FDA is investigating an outbreak of Salmonella linked to that manufacturing facility.

HP Hood LLC is voluntarily recalling the products listed below. The company initiated the voluntary recall in response to an expanded recall by Peanut Corporation of America (PCA). Bear Naked Announces Recall of Appalachian Trail Mixes Due to Possible Peanut Corporation of America Contamination and Potential Health Risk (January 31)
As a result of the expansion of Peanut Corporation of America’s recall to include all peanut ingredients produced in their Blakely, Georgia facility since Jan. 1, 2007, Bear Naked today announced a voluntary nationwide recall of Bear Naked All-Natural Appalachian Trail Mix products. No illnesses have been reported to date in connection to these Bear Naked products. No other Bear Naked products are involved in this recall.

Salix LLC of Deerfield Beach, FL a manufacturer of rawhide dog chew products, is voluntarily recalling its Healthy Hide 6″ Peanut Butter Filled Shank Bone because it contains peanut butter made by Peanut Corporation of America (PCA).
Weis Markets Announces Voluntary Recall of Seven Ice Cream Products Due to Possible Health Risk (January 30)
Weis Markets today issued a voluntary recall as a precautionary measure for seven of its ice cream products which may be contaminated with Salmonella since they contain peanuts supplied by the Peanut Corporation of America (PCA) which has been linked to a national outbreak of salmonella. Two of these products were discontinued in August and September.
